MEDIATION

Mediation is one of the forms of alternative dispute resolution –or ADR. 

The courts are overcrowded, the costs of litigation, all the way through a jury trial are enormous and burdensome on most people and companies. Over the last decade or so, mediation has evolved as a standard answer to the overcrowding of the courts. In almost every instance, parties are ordered to mediation prior to having the advantage of trial.

I have been involved in the mediation process, both as a trained mediator and as a litigant, for over fifteen years and know that the process works. 

Most of the Courts in Smith County, Texas require that the parties attend mediation prior to any trial of their case.  Litigants are free to choose their own mediator, but in most cases the Judge orders the parties to mediation and selects the mediator.  I am regularly referred cases for mediation by the judges of the County and District Courts of Smith County.
